What Happens When a Report Is Made?

Responsible Employee

  • A responsible employee is a campus employee who has the authority to redress sexual misconduct; who has the duty to report incidents of sexual misconduct to the Title IX Coordinator or other appropriate designee; or whom a student could reasonably believe has this authority or duty. Responsible employees includes all administrators, faculty, staff, and student workers except:
    • Any employee with confidentiality obligations as defined by the Sexual Misconduct Policy
    • Cafeteria staff who are not assigned administrative duties
    • Custodial staff who are not assigned administrative duties
    • Groundskeeper staff who are not assigned administrative duties
    • Maintenance staff who are not assigned administrative duties
    • Ranch/agricultural staff who are not assigned administrative duties
    • Other staff of campus physical plant who are not assigned administrative duties
  • If you choose to disclose an incident of sexual misconduct to a responsible employee at Lamar University, your disclosure will be sent to the Title IX Coordinator for investigation.
  • You may choose to report directly to the Title IX Coordinator.

Institution

  • If you choose to report directly to the Title IX Coordinator, the Title IX Coordinator will conduct an investigation into your report.
  • You will receive information about support services available to you, and any reasonable accommodations will be coordinated through this office.
  • The option of reporting to law enforcement will also be explained to you.
  • No information will be provided to law enforcement without your permission.
  • The university adjudication process for sexual misconduct and Title IX is explained in detail in the Sexual Misconduct Policy.

Law Enforcement

  • If you choose to report to the Lamar University Police Department, they will take your report and provide you the option of criminal prosecution and/or the sexual misconduct adjudication process.
  • You may choose to have your identity protected with a pseudonym as per Texas law. Notice of the incident will be provided to the Title IX Coordinator for the university Title IX investigation.
  • The police will provide you with resource options, and the Title IX Coordinator will ensure your access to support services.
  • Deciding to pursue criminal charges will not negate the university’s investigation, and both will proceed concurrently.
  • If the incident occurred outside of Jefferson County, the Lamar University Police Department will assist you in contacting the appropriate jurisdiction to investigate, should you desire to do so.

Confidential

  • If you choose to report confidentially, the Student Health Center will ensure your health and well-being and will provide access to available resources.
  • No one else will be notified of your report. The Student Health Center will provide statistics to the University Police for the Annual Security Report, but your identity will not be released.
  • If you choose to file an anonymous report, the Title IX Coordinator will conduct an investigation to the extent possible based on the information provided.
  • The police department may be asked to assist if the report generates a concern for overall public safety.
